Compulsory purchase and notices to treat
 
Union Railways (North) Ltd and London and Continental Railways Ltd v. Kent County Council [2008]. The Lands Tribunal has ruled that an authority that compulsory acquires land must give notice to treat every person with an interest in that land including an equitable interest. Failure to serve notice on a person with an interest will entitle that person to claim compensation under section 10 of the Compulsory Purchase Act 1965 and refer the claim to the Lands Tribunal.
