Rural Property and Environmental Issues

We have wide experience of advising farmers, landowners and people affected by farming or other rural property uses on a broad spectrum of environmental issues.

Examples include:

  • claims of statutory or private nuisance arising from agricultural uses (typically smells or noise)
  • claims of statutory or private nuisance arising from non-agricultural uses (for example clay pigeon shoots, motor sports and agricultural equipment)
  • water pollution
  • flooding and run off claims
  • waste disposal and landfill
  • SSSI prosecutions and disputes over the designation of land with high nature conservation value and species protection
  • disputes over Countryside Stewardship Agreements, Higher Level Environmental Stewardship Agreements and other similar agreements
  • issues relating to common land

We prepare and negotiate terms for joint venture and other agreements between landowners and Natural England and non-governmental nature conservation organisations. We also advise on nature conservation and compensation and/or mitigation schemes associated with major developments (including windfarms).
