Residential Landlord and Tenant

We deal with residential tenancy disputes under the three private sector regimes:

  • Rent (Agriculture) Act 1976
  • Rent Act 1977
  • Housing Act 1988

and also offer advice in connection with enfranchisement and lease extension in relation to flats and houses under the Leasehold Reform (Housing and Urban Development) Act 1993.

Examples of the work undertaken include advice in respect of:

  • security of tenure
  • succession
  • dilapidations
  • rent arrears
  • fair rent and rent review
  • possession
  • tenant insolvency
  • ADHAC procedures under the Rent (Agriculture) Act 1976 and Housing Act 1988 
  • service occupancies

We provide advice at all stages including the preparation and service of any necessary notices, and undertake advocacy both in the courts and before the ADHAC.

We also deal with the letting of residential properties from the provision of standard tenancy agreements and the grant of assured shorthold tenancies to agricultural workers through to the drafting of bespoke tenancy agreements for the letting of highly individual properties. 

We undertake audits of residential property portfolios, providing advice on security of tenure, succession rights, conversion between regimes and rent review.
